E171-FREE PRODUCTS
On 18 January 2022, Commission Regulation (EU) 2022/63 of 14 January 2022 amending Annexes II and III to Regulation (EC) No 1333/2008 of the European Parliament and of the Council as regards the food additive titanium dioxide (E 171) and withdrawing the authorisation to use the food additive titanium dioxide (E171) in foodstuffs was published in the Official Journal of the European Union.
The Regulation will enter into force on the 20th day following that of its publication.
According to this regulation, until 7 August 2022, food produced in accordance with the rules applicable before 7 February 2022 may continue to be placed on the market. After that date, they may remain on the market until their date of minimum durability or use-by-date.
The decision to refuse the authorisation of titanium dioxide is based on a scientific opinion of the European Food Safety Authority (EFSA) which indicated that, on the basis of all available evidence, genotoxicity concerns could not be excluded, it has not been established that titanium dioxide (E171) does not have an adverse effect on animal health, human health or the environment when used as an additive and that therefore the conditions for authorisation, as provided for in Regulation (EC) 1831/2003, are not satisfied and authorisation should be refused.
Titanium dioxide (TiO2) is used to add white colour to many foods, from baked goods and sandwich spreads to soups, sauces, salad dressings and food supplements.
